Terms of sale

1.1. SIA Bianco & Nero, hereinafter referred to as the Seller, publishes the Public Offer for sale of products based on the samples presented on the official Web-Site of the Seller www.bianeri.com.

1.2. In accordance with the effective legislation of the Republic of Latvia, this document is the public offer, and if the conditions set out below are accepted, the individual who accepts this offer pays for the Seller's Products in accordance with the terms of this Agreement. Payment for the Products by the Buyer is acceptance of the offer which is considered equivalent to the conclusion of the Agreement under the terms set out in the offer.

1.3. Based on the above, carefully read the text of the public offer, and if you do not agree with any point of the offer, you are invited to refuse to purchase Products or use the Services provided by the Seller.

1.4. In this offer, unless the context requires otherwise, the following terms have the following meanings:
The Offer – the public offer of the Seller addressed to any individual to conclude the sale agreement with him/her (hereinafter referred to as the Agreement) under the existing terms contained in the Agreement, including all appendices thereof.
The Buyer – an individual or a legal entity that has concluded the Agreement with the Seller under the terms contained in the Agreement.
Acceptance – the Buyer's full and unconditional acceptance of the Agreement terms.
The Product – a list of assortment items on the official Web-Site.
The Order – individual items from the Product assortment list specified by the Buyer when making a request on the Web-Site.

2.1. The Seller sells the Product in accordance with the current price list published on the Seller's Web-Site and in the catalogue www.bianeri.com, and the Buyer makes payment and accepts the Product in accordance with the terms of this Agreement.

2.2. This Agreement and annexes thereto are official documents of the Seller and the integral part of the offer.

3.1. The Order of the Product is carried out by the Buyer through the Web-Site filling in the registration form. When ordering the Seller's products, the Buyer shall provide the following registration information about himself/herself:
- last name, first name;
- date of birth;
- sex;
- E-mail and postal address;
- contact phone number.

3.2. When placing the Order through the Web-Site, the Buyer shall provide information specified in clause 3.2. of this Agreement. The Buyer accepts the terms of this Agreement by entering the relevant data in the registration form when placing the Order through the Web-Site. The Buyer has the right to edit the registration information about himself/herself. The Administrator does not change or edit the registration information about the Buyer without the consent of the latter. The Seller shall not disclose the Buyer's data specified during registration on the Web-Site www.bianeri.com and when placing the Order to persons who are not related to execution of the Order. After placing the Order through the Web-Site, the Buyer receives a unique identification number of the order. The Administrator informs the Buyer via E-mail about availability of this product in stock. The Buyer confirms his/her consent by replying to this letter. After agreeing with the Administrator of the selected product, the Buyer may pay therefor.

3.3. The Seller and the Administrator are not responsible for content and accuracy of information provided by the Buyer when placing the Order.

3.4. The Buyer is responsible for accuracy of information provided when placing the Order.

3.5. Payment by the Buyer for the Order made independently on the Web-Site means that the Buyer agrees to the terms of this Agreement. The day of payment for the Order is the date of conclusion of the Sale Agreement between the Seller and the Buyer.

3.6. All information materials presented on the Web-Site www.bianeri.com have reference nature and cannot fully convey reliable information about certain properties and characteristics of the Product. If the Buyer has any questions regarding the properties and characteristics of the Product, before placing the Order, he/she shall consult the Administrator.

4.1. The Seller shall deliver the Product to a courier service within 1-3 business days.

4.2. The Order is considered delivered by the Seller at the time of transfer thereof to a courier service.

4.3. If the Buyer provides false information about his/her contact details, the Seller is not responsible for improper execution of the Order.

4.4. In the case of improper delivery of the Order due to the fault of the Seller, the re-delivery of the Order is carried out free of charge.

5.1. Payment for the Order is made with the Buyer's bank card. Confirmation of payment is transfer of funds to the account of the issuing bank.

5.2. The price for each item of the Product is indicated on the Seller's Web-Site.

5.3. The Order is accepted for execution only upon receipt of the Buyer's funds to the Seller's bank account. The Seller guarantees availability of the Product in stock in a request confirmed by the Administrator within three (3) business days. If the Buyer has not paid within three (3) business days, the Product may be sold to another person.

6.1. All text information and graphic images posted on the Web-Site www.bianeri.com are the property of the Seller and/or its suppliers and manufacturers of the Products.

6.2. It is prohibited to use in any way materials, frames, texts, any works of literary, scientific or art works, other results of intellectual activity or means of individualization presented on the Seller's Web-Site (www.bianeri.com) without the prior written permission of the Contractor.

7.1. The Seller is not responsible for improper use of the products by the Buyer.

7.2. The Seller has the right to transfer its rights and obligations for execution of Orders to the third parties.

7.3. The Seller has the right to record telephone conversations with the Buyer. Telephone conversations are recorded in order to monitor the activities of the Administrator and control the quality of Order execution.

7.4. The Seller shall prevent attempts of unauthorized access to information and/or transfer to persons who are not directly related to execution of Orders; to detect and prevent such facts in a timely manner.

7.5. The Buyer has the right to send all claims for improper execution of the order to the E-mail address bianeri@bianeri.com or inform the Administrator at the phone number listed on the Web-Site. All received information is processed as soon as possible.

8.1. This Agreement comes into force after the Customer performs the actions provided for in clauses 3.2. and 4.1.
